Documents | Simms, John Will Georgia Coweta County I John Simms Sen of the County and State aforesaid make ordain and constitute this to be my last will and testament revoking all other wills heretofore made by me in the following manner, to wit; 1st Its my will that all my just debts be paid. 2nd I give my plantation stocks of all kinds & plantation tools of all kind also house hold & kitchen furniture all my negroes with the exception of one by the name of Taylor which already given to son BRITAIN all the property above named I give my wife which is not given to son Britain also all debts due of any kind and money if any on hand to my wife COMFORT Simms during her natural life The condition of money matter are such that my wife is to use all the interst which may accrue on all the money that may be due or money on hand at the time of my death 3rd Its my will that the following named Grand Children shall have two hundred dollars out of my estate after the death of my wife MARY M STRICKLAND ALADA G MELSON WILLIAM MELSON MILDRED BURCH PENELOPE HOUSTON also JOHN G SIMMS my Grand Son five dollars and after the death of my wife that all the negroes given to my wife be appraised and drawn for among my own children also all the estate with the exception of the negroes as above stated be divided among my own children I hereby nominate & appoint my Son Britain Simms my executor to this my will /s/ John Simms [?] Attest Decr 29th 1863 E J Bastrom [?] Hill James P Askew Court of Ordinary January Term 1864 In open court personally came Will G Hill & James P Askew who being duly sworn deposeth & saith that they saw John Simms sign seal declare and publish the writing contained on this paper as his last will & Testament freely voluntarily and of his own accord and without any compulsion or influence whatever and that at the time of the execution of the said will the said John Simms was of sound and disposing mind & memory that deponents signed said will as witnesses in the presence of the testators and at his instance and request and in the presence of each other and that they saw E J Bastrom sign also as a witness as aforesaid Sworn to & Subscribed in open Court U B Wilkinson Ordy Recorded Jany 30th 1864 T M Thomas Dept CCO "Georgia, Probate Records, 1742-1990," images, FamilySearch (https://familysearch.org/pal:/MM9.3.1/TH-1951-30620-20857-6?cc=1999178&wc=M946-BL4:365361295 : accessed 01 Jan 2014), Coweta > Wills and returns 1828-1892 vol A-B > image 399 of 522. | |
