"The cause was continued until the Spring term, eighteen hundred [478] and thirty-seven, when this entry appeared: 'enjoined and continued;' and at the succeeding term, 'continued, and the intermarriage of Martha Weatherford with Peyton Downey suggested, a scire facias to issue.' A scire facias accordingly issued to said Downey, to appear and show cause why he should not be made a party plaintiff to the suit, which was returned, executed."
